Hicks and Hicks will deal with the customer's order in accordance with our obligations under the Sale of Goods Act 1979 (as amended) and the Sale and Supply of Goods to Consumers Regulations 2002.
Our products have been selected on the basis that they will be used for the personal use and we will not be liable for any loss resulting from commercial use of our products.
If the customer is not satisfied with the quality of the ordered items(s) Hicks and Hicks will, after inspection of the goods, follow a strict policy of Repair, Replace and finally Refund, depending on which remedy is the most appropriate.
In the case of a refund, you will be eligible for a full refund less the cost of any shipping charges previously incurred as these are considered complete at that point. Hicks and Hicks retains ultimate discretion on whether a product is deemed faulty or not.
All our consumer contracts are governed by English law and shall fall under the exclusive jurisdiction of the courts of England. English is the official language offered for the conclusion of the contract.
The statement of our terms and conditions of trade is in accordance with your statutory rights under the legislation above.
"Customer" means any person who is purchasing items from the Supplier."Supplier" means Hicks and Hicks
Title in the Goods shall not pass until the price of the purchased items has been paid in full for the Goods.
The supplier warrants that the product description will correspond with the description logged by the customer at the time of purchase.
All purchases made at supplier, are made pursuant to a shipping contract. By purchasing from supplier, the customer agrees that the title to and risk of loss for such items passes to themselves upon delivery of the items.
Use of this website implies that all the terms and conditions in regards to orders placed, order placement and other issues concerning orders, as outlined here have been accepted and agreed to.
It is understood that an order, once it has been submitted and subsequently processed, cannot be cancelled. Should it under some circumstances, be agreed by the Supplier to cancel an order, cancellation charges relevant to the product would be deducted from the submitted payment before a refund is issued or a charge back made to the card used for payment submission.
Any changes must be made to an order within 24 hours of placing the order; making a change within 24 hours of placing the order does not guarantee that a change can be made. The Supplier will, where possible, endeavour to make changes. All changes to an order, once the order has been processed and where a change remains possible, will carry a £20 change fee per change which is in addition to the difference in any charges associated with that change, be it changes to colours, fabrics, styles, sizes or any other aspect.
As each bespoke item is made to order, the Supplier is unable to resell an order to any Customer other than the Customer placing the order, and as such the Supplier cannot accept returns on the basis of a change of heart on the part of the Customer. Neither can the Supplier accept returns where the Customer requests a change to an existing order and the Supplier cannot fulfil that change. Where there is a dispute between Customer and Supplier over the styling of the order, the record on the Supplier's ordering system is taken as the firm and final order.
It is understood that turnaround and dispatch of the orders placed at the Supplier may vary from time to time depending on current order volumes, work schedules, material availability or a particular characteristic of the order placed. The Supplier will try its best to comply with the expected delivery date from payment. Dispatch times may vary according to availability, any guarantees or representations made as to delivery times are limited to mainland UK and subject to any delays resulting from postal delays or force majeure (including Acts of God, Acts of War or Acts of Terrorism) for which we will not be responsible. The supplier will not be responsible for such delays resulting from situations within the recipient's control, such as recipient not being available to accept delivery, or incorrect delivery details supplied.
Alterations are only included in purchases made by appointment at the London studio and at the 'by appointment' price.
Alterations are not included if there has been a change in size or dimension of the customer after the initial measurements have been taken, this includes any changes in dimensions due to pregnancy or weight loss or gain.
At Hicks and Hicks we make every effort to ensure your purchase gets to you as quickly, safely and cost effectively as possible. Please note, however, that the delivery of your order may be restricted depending on the size, weight and chosen destination of the package. Other factors such as weather and mechanical difficulties can also result in later deliveries. If the delivery address is different to the billing address then we may have to run further checks to ensure your credit card security, this may result in longer delivery times.

We will send you an initial email confirming receipt of your order; then a further email confirming that your order is ready for dispatch along with your shipping reference number. Where an item is not in stock, we will advise you of the anticipated time for delivery (if such item will be available in future). Orders can be delivered to either business or residential addresses, however all packages will require a signature on receipt of delivery. It is customary for the dispatch companies we use to leave a notification card with their contact information if the delivery address is unattended at the time of delivery, however this may not always be the case. Hicks and Hicks cannot take responsibility if a notification card is not left in any instance.
We've tried to keep our delivery costs as straightforward and cost effective as possible while still offering a great service. Pricing details are as follows but don't worry, you won't need to calculate delivery, that will all be done for you at the checkout stage.
Small items have a delivery charge of UK = £3.95
Medium items have a delivery charge of UK = £12.50
Large items have a delivery charge of UK £25
Outsized items delivery charge of UK £100

Bespoke items are made to measure and after manufacturing has begun cannot be cancelled or amended so before ordering any made to measure items please be completely sure that you order what you require.

Anything that is temporarily out of stock can be kept on backorder for you, and will be sent to you at no extra cost as soon as it is back in stock - you can email us at firstname.lastname@example.org if you have a specific enquiry.
Any goods that arrive damaged should be reported within 24 hours of receipt so that we can contact the courier. Any claim for damages later than 24 hours from receipt will not be entertained.
Any non bespoke items purchased from us may be returned to us within 7 days of receipt provided they are returned complete, in perfect condition, unused, and with the original packaging.
For all returns you will be required to arrange and pay for the return of the products to us. We will, however, send our exchange back out to you by Recorded Delivery at no extra charge.
To return any products to us, please email us first at email@example.com to advise that you would like to arrange a return or exchange. In the subject heading please state RETURN or EXCHANGE whichever is appropriate. If you are making an exchange, please give details of the item you wish to receive in exchange, i.e. item name, size, colour. Exchanges are made subject to stock availability. Within 48 hours you will receive confirmation of your request and a returns number. Please print this email and enclose it in the parcel along with a copy of your receipt. Please ensure the packaging you use to return the item to us is suitable for despatch to avoid damage.
We would strongly recommend that all exchanges and returns are sent to us by Recorded Delivery as we cannot accept responsibility for parcels lost in transit.

You will receive your refund credit, cheque or exchange order (when in stock) within 7 working days of us receiving the goods. We endeavour to process this as quickly as possible. Your refund will include the original delivery charge.
Please note that we are unable to refund an item without a receipt and that the refund will only be given to the original payer.
